CPAP Law Suit Signed Cases
About 25 million Americans suffer from sleep apnea, and many of them used Philips CPAP and BiPAP machines to treat the disorder so they could sleep safely. Unfortunately, many of these machines contained toxic, potentially cancer-causing chemicals that users inhaled or swallowed. If your law firm wants to represent clients injured by defective medical devices, we can find them for you.
What is Obstructive Sleep Apnea?
Those with obstructive sleep apnea repeatedly stop and start breathing when they sleep, according to the Mayo Clinic. Their throat muscles relax and block the airway during sleep, often causing the person to snore. About 22 million Americans have sleep apnea, with obstructive sleep apnea the most common form, reports the Lansing State Journal.
These temporary closures of the airway can happen as often as 30 times per hour, according to Harvard Health Publishing. Though anyone could have the condition, it’s most common in men older than 40 who are overweight or obese.
Each time breathing stops, the body’s oxygen level decreases, and adrenaline, a stress hormone, is released by the body. High adrenaline levels may result in high blood pressure over time. Repeated blood pressure surges may damage the linings of blood vessels. Sleep disturbances can also increase the amounts of harmful LDL cholesterol and other blood fats.
This combination of changes over time can clog arteries and reduce heart function. Those with untreated sleep apnea are twice as likely to have a heart attack than those without the disorder.
Common ways to treat the condition include the use of a continuous positive airway pressure machine (CPAP) or bilevel positive airway pressure (BiPAP) machine.
What is a CPAP? What is a BiPAP?
Your lungs expand when you inhale, thanks to your diaphragm, the primary muscle in your chest used for breathing. The pressure inside the tubes and air sacs in your lungs drop and you suck oxygenated air into your lungs.
If you have difficulty breathing during sleep due to sleep apnea, a BiPap pushes air into your lungs. It includes a mask or nasal plugs connected to a ventilator. The machine puts pressurized air into your airways. The process is called “positive pressure ventilation” because the device opens your lungs through air pressure.
A BiPAP provides positive air pressure when you inhale and exhale, but the pressure’s higher when you breathe in. CPAP delivers the same pressure whether you breathe in or out. Which machine is better for a patient depends on their condition.
Why are Philips CPAP and BiPAP Machines Targets of Litigation?
Philips Respironics recalled CPAP, BiPAP, and mechanical ventilators that use PE-PUR, a type of polyurethane foam in June 2021. This foam contains volatile organic compounds which are toxic and potentially cancer-causing. It was used to reduce sound and vibration in the machines, but it may break down and be inhaled or swallowed by the user, which could result in serious injuries.
The federal Food and Drug Administration (FDA), on June 30, 2021 issued more information, including a list of all the affected devices and a series of questions and answers for their users, caregivers, and healthcare providers. The company stated they would repair and replace the recalled machines (an estimated three to four million), but it may take a year before all those affected will get new or refurbished devices.
