IF YOUR FIRM HELPS THOSE SUFFERING DUE TO EXPOSURE OF TOXIC SUBSTANCES, ZERORISK CASES CAN HELP YOU WITH LUNG CANCER AND MESOTHELIOMA CASES.

Cancer is caused by changes to certain genes that alter the way our cells function, according to the National Cancer Institute. Some changes may happen naturally when DNA is replicated during the process of cell division, with the end result a malignant cell. Other changes are due to environmental exposures that damage DNA.

The lungs are two spongy organs in your chest that take in oxygen when you inhale and release carbon dioxide when you exhale. Lung cancer is the top cause of cancer deaths in the US. More Americans die of it than colon, prostate, ovarian and breast cancers combined. Those who smoke have the greatest risk of lung cancer, but it occurs in people who have never smoked.

Types of lung cancer and symptoms

There are two types of lung cancer:

  • Small cell: It occurs almost exclusively in heavy smokers and is less common than non-small cell lung cancer.
  • Non-small cell lung cancer: This is a catch all term for several types of lung cancers that behave in a similar way. They include squamous cell carcinoma, adenocarcinoma and large cell carcinoma.

Lung cancer doesn’t normally present symptoms until the disease is advanced. They include:

  • A cough that won’t end
  • Coughing up blood
  • Shortness of breath
  • Chest pain
  • Hoarseness
  • Unexplained weight loss
  • Bone pain
  • Headache

How well do Lung cancer treatments work?

There are several potential approaches to treating lung cancer, depending on the type and if it has spread. Those with non-small cell lung cancer can be treated with surgery, chemotherapy, radiation therapy, targeted therapy, or a combination of these treatments. If it’s small cell lung cancer, treatment is usually radiation therapy and chemotherapy.

Possible treatments include:

• Surgery physically remove tumors
• Chemotherapy medications prevent tumors from growing or spreading, they could also shrink or destroy the tumors
• Radiation therapy uses high-energy rays, similar to X-rays, to kill cancer cells
• Targeted therapy is the use of drugs to block the growth and spread of cancer cells.
• Immunotherapy, the use of medications to stimulate the person’s immune system to recognize and destroy cancer cells, is just starting to be used

The survival rates for lung cancer depend on if the cancer has spread from the lungs to other organs or bones. The percentage of those living five years after being diagnosed with small cell carcinoma that was only in the lungs is 60%, according to the American Cancer Society. It drops to 6% if the cancer has spread to distant parts of the body.

Toxic substances and cancer

We can take steps to limit exposure to some cancer-causing substances, such as tobacco smoke, but we can only do so much. Toxic substances are in the air we breathe, the water we drink, the food we eat, and the materials we use at work.

The substances listed below are some of the most likely carcinogens to affect human health, according to the National Toxicology Program’s 14th Report on Carcinogens. Just because a substance is considered a carcinogen, doesn’t mean it necessarily caused a particular cancer. Many factors impact whether someone exposed to a carcinogen will develop cancer, including the amount and duration of the exposure, the individual’s genetic background and how effective the person’s immune system is with killing malignant cells.

Burden of proof

In a civil lawsuit the plaintiff has the burden of showing that it’s more likely than not the defendant caused harm to the plaintiff. Given how much is unknown about cancer, the need to show the plaintiff was exposed to a certain substance, the defendant in some way is linked to the substance and it caused the lung cancer, the devil is in the details in these cases. But if that burden can be carried, given the suffering lung cancer causes and the high risk of death, a successful case would be quite a win for your firm and your client.
